| Kansas School Counselor Association ARTICLE I Name and Purpose Section 1 - Name. The name of this organization shall be the Kansas School Counselor Association KSCA); a division of the Kansas Counseling Association and the American School Counselor Association (ASCA). Section 2 - Purpose. The purpose of this Association shall be to support the Kansas Counseling Association and the American School Counselor Association, and to support and enhance excellence in professional school counseling at all educational levels in the state of Kansas. ARTICLE II - Membership and Dues Section 1 - Types of Membership. The Association shall include three types of membership: Professional, Regular, and Student. Section 2. Requirements of Membership. In order to qualify for membership, an individual must hold concurrent membership in KCA and must meet one of the following requirements: (a) Professional Membership The individual must be a member of the American School Counselor Association. A Professional member of KSCA, upon payment of dues may vote, hold office in KSCA, be a member of the Governing Board, be a chairperson of a Standing or Special Committee, and/or be a delegate from KSCA to the ASCA Delegate Assembly. (b) Regular Membership The individual who actively engages in guidance and school counseling at any level of education and/or holds a Masters level degree in school counseling but does not hold membership in ASCA, may become a Regular member of KSCA upon payment of dues. A Regular member may vote on local and state issues only and may be a member of a Standing or Special Committee. A Regular member is eligible to hold any state office in KSCA except that of President or President Elect, but may not be a delegate from KSCA to the ASCA Delegate Assembly. (c) Student Membership The individual who meets the Student membership requirements of KCA may become a Student member of KSCA upon payment of dues. A student member may attend and participate in meetings and conferences. He/she is not eligible to vote, hold office or be a delegate from KSCA to the ASCA Delegate Assembly. Section 3 - Dues (a) The fiscal year shall run from July 1 to June 30. Student members shall pay one-half of the annual dues. (b) Membership shall be notified of proposed changes in dues recommended by the Governing Board prior to the annual business meeting. The proposed dues shall become effective upon approval of one-half of the members voting. ARTICLE III - Officers Section 1.- Officers and Terms of Office. (a) The officers of KSCA shall be President, President Elect, Immediate Past President, four level Vice-presidents and a Secretary-Treasurer. (b) The President and President Elect shall be Professional Members of KSCA. All other officers may be Regular Members of KSCA. (c) The President Elect shall automatically succeed to the office of President. In case of an unexpired term in the office of President, the President Elect shall become President and shall serve this unexpired term in addition to his/her regular term of office. (d) The four Vice-presidents and the Secretary-Treasurer shall hold office for two years and may succeed themselves once. (e) Vacancies in the office of President Elect, four Vice-presidents, and the Secretary-Treasurer occurring before the expiration of the normal term of office shall be filled through nomination and election by the vote of the remaining voting members of the Governing Board. The officer so elected shall serve until the expiration of the normal term of office and may succeed himself/herself if elected by members of the Association. (f) The term of office for any elected officer shall coincide with the fiscal year(s), July 1 through June 30. Section 2.- Duties of Officers. (a) The President shall be the chief executive officer of the Association and Chairperson of the Governing Board, call and preside at all meetings of the Governing Board and Association meetings except as provided in (b) of this section. The president shall appoint all chairpersons of Standing and Special committees, serve in a liaison capacity with KCA and its divisions, be a voting member of the Executive Council of KCA and be empowered to conduct affairs of the Association as prescribed by the Governing Board during the time the Governing Board and the Association are not in session. (b) The President Elect shall serve as a member of the Governing Board, shall act in place of the President at all meetings the President is unable to attend, assist the President in his/her duties, and coordinate Programs for the Association. The President Elect should be a delegate to the National Convention. (c) The Immediate Past President shall serve as a member of the Governing Board, and shall be chairperson of the Nominations and Elections committee. (d) The four Vice-presidents shall be responsible for generating interest and activities within the four following work settings respectively - elementary, middle or junior high, senior high and post-secondary schools. They shall serve as members of the KSCA Governing Board. (e) The Secretary-Treasurer shall serve as a member of the Governing Board, keep the records and minutes of the Association and of the Governing Board, issue notices of meetings, collect dues from the KCA Treasurer, disburse all funds of the Association with the approved budget, and make financial reports to the Governing Board and the Association at its annual meeting. The records of the Treasurer shall be audited immediately prior to the expiration of their term of office by an auditing committee of three members appointed by the Governing Board. The Secretary-Treasurer shall assist the President Elect with a budget for the forthcoming year. Section 3 - Election of Qfficers. (a) Election of officers shall coordinate with the election of KCA officers but shall take place prior to the close of the annual business meeting with the voting members of KSCA participating. (b) The selection of balloting procedure shall be determined by the Governing Board and shall be one of the following: by ballot if members receive their ballots at least three weeks prior to the annual business meeting -I or by written ballot at the annual convention of KCA with the members in attendance voting. (c) Candidates receiving the largest number of votes shall be declared elected. (d) The President Elect shall be elected annually. (e) The Elementary and Secondary Vice-presidents and the Secretary-Treasurer shall be elected on even-numbered years. The Middle Level and Post-Secondary Vice-Presidents shall be elected on odd-numbered years. ARTICLE IV - Governing Board. Section 1 - Membership. (a) The voting members of the Governing Board shall be the elected State officers of the Association and the Chairpersons of the Standing Committies. (b) Any Kansas ASCA officer, Kansas ASCA Governing Board member or Kansas Regional Coordinator is a non-voting member. Section 2 - Powers and Functions. (a) The Governing Board shall be the agency through which the general administration and executive functions of the Association shall be carried out. The President of the Association shall be the Chairperson of the Governing Board. (b) The Governing Board shall manage and conduct the business of the Association between its official meetings. (c) The Governing Board shall fill vacancies of the Association in accordance with Article 111, Section 1, of these Bylaws. Section 3 - Meetings. (a) The Governing Board shall meet at least twice a year at a time and place designated by the President or by a majority of the voting members of the Governing Board. (b) Members of the Governing Board shall be notified at least ten days prior to the date of the meeting. (c) The duly notified voting members at a Governing Board meeting shall constitute a quorum. ARTICLE V - Association Meetings Section 1 - Regular Meetings. There shall be a state-wide meeting of the Association held each year at a time and place designated by the Governing Board. Section 2 - Special Meetings. Special Meetings of the Association shall be included in the KSCA News or shall be mailed to each member at least ten days prior to the date of such meeting. Section 3 - Notice of Meetings. Notice of meetings of the Association shall be included in the KSCA News or shall be mailed to each member at least ten days prior to the date of such meeting. Section 4 - Quorum. A quorum for the transaction of business shall consist of the Professional and Regular members of the Association present at any Association meeting to which published or written notice was given. ARTICLE VI - Committee Section 1- Standing Committee. (a) The Government Relations Committee shall inform the membership of national and state legislative issues that relate to counselors. (b) The KSCA Membership Committee shall verify membership status and recruit members for both KSCA and ASCA. (c) The Awards Committee shall elicit nominations for "KSCA School Counselor of the Year" award and other awards the Governing Board elects to give. The committee shall coordinate the awards and accompanying ceremony. (d) The KSCA Publications Committee shall gather and disseminate information by means of the KCA News or the KSCA Newsletter. The Committee may make recent publications of professional literature available for sale. (e) The KSCA Public Relations Committee shall coordinate activities promoting School Counseling Week and media exposure of school counseling and/or KSCA activities. (f) The KSCA Nominations and Elections Committee shall prepare a doubleslate of candidates for the elective offices of the Association. The committee shall check the candidates eligibility for office, notify candidates of the duties and terms of said office, and secure the consent of the proposed candidates. The committee shall conduct and certify the elections. (g) The KSCA Advocacy Committee shall coordinate activities which support the school counselor's role and emphasize the importance of Association involvement. (h) The KSCA Professional Development Committee shall provide information and coordination of all professional development activities for KSCA. The committee shall conduct or coordinate workshops relating to professional development. (i) Each chairperson of a Standing Committee shall be responsible for appointing his/her committee members, and of notifying the President of his/her selections. Section 2 - Special Committees. Special Committees shall be established by the President as the need arises. They may be dissolved by the President and the Governing Board when their purpose has been accomplished. ARTICLE VII - Amendments and/or Revisions A proposal to amend or revise these By Laws may be initiated by the Governing Board or by an individual member, provided the member has the signature of at least ten members. Such an amendment or revision may be adopted or rejected by a majority vote of the members present at a special or annual meeting of the Association provided that the proposal has been presented in writing to the members at least thirty days prior to said meeting. A proposal to amend or revise these Bylaws may also be adopted or rejected by a mail ballot of the Association members. A majority affirmative vote from the members returning ballots within the succeeding thirty days from the date of mailing ballots is required for adoption. |
